Welcome to Halcyon Privé. These Terms of Service ("Terms") govern your access to and use of our website located at halcyonprive.com (the "Site") and all related services provided by Halcyon Privé (collectively, the "Services").   • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site or Services;
  • Impersonate or attempt to impersonate Halcyon Privé, a Halcyon Privé employee, another user, or any other person or entity.

3. Booking Requests & Concierge Services

Our Site allows you to submit enquiries and booking requests for curated travel experiences. All such enquiries are subject to availability and confirmation by our concierge team. Prices displayed on the Site are indicative and may vary. A contract for any travel services is formed only when we have confirmed your booking and received any required deposit or payment in full, as specified in your confirmation invoice.

4. Intellectual Property

The Site and its original content, features, and functionality—including all information, text, graphics, logos, and images—are the exclusive property of Halcyon Privé and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5. Links to Third-Party Sites

Our Services may contain links to third-party websites or services that are not owned or controlled by Halcyon Privé. We do not endorse or assume any responsibility for these third-party sites. You access any third-party site at your own risk and should review the terms and privacy policies of such sites.

6. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. Halcyon Privé makes no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the Services. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

In no event shall Halcyon Privé, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages. Our total liability to you for all claims arising from or related to the Services shall not exceed the greater of (a) USD 100 or (b) the amounts paid by you to Halcyon Privé in the twelve (12) months preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless Halcyon Privé and its affiliates, licensors, and service providers from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) resulting from your violation of these Terms or your use of the Services.

9. Termination

We reserve the right to suspend or terminate your access to the Services at any time and for any reason, including for violation of these Terms. Upon termination, all provisions of these Terms which by their nature should survive will survive—including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of New York, NY, without regard to conflict of law principles. Any dispute arising under or related in any manner to these Terms shall be resolved exclusively in the courts of New York, NY.

11. Changes to These Terms

Halcyon Privé reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised Terms.
